Training the Trainers/Agreement for trainers

Suggested memorandum of understanding for participants on Train the Trainers courses at Wikimedia UK. This was originally put together by Candy on 19/11/2012, and read through by Doug and Martin, and it was felt that in general it does the job. It has been recently forwarded to Saad for a legal look through, but the Education Committee's input would be valuable in the meantime.

1. This document is a memorandum of understanding document between ____ (the Participant), _________ [address], and Wikimedia UK (the Provider) concerning the provision of Wikimedia training courses to third party organisations and individuals in the future.

2. The trainer undertakes not to use the trademarks "Wikimedia" or "Wikimedia UK" in a way that implies endorsement, without written permission from the appropriate staff member of Wikimedia UK. If there is a team of trainers delivering training, just the lead trainer has to have permission, not all the trainers individually.

3. The Participant agrees to contribute towards Wikimedia UK activities designed to realise the objectives of the charity.

4. The Participant shall not describe or represent themselves, verbally or in writing, to any organisation as a Wikimedia UK Approved or Accredited Trainer, with the aim of selling or providing Wikimedia related training independently of Wikimedia UK.

5. Wikimedia UK will use its best endeavours to provide the Participant with the opportunity to attend a two day UK-based Wikimedia Training for Trainers course within the next twelve months. (propose delete this clause as irrelevant Jon Davies (WMUK) (talk) 13:39, 7 February 2013 (UTC))

6. The Participant will have their reasonable expenses for attending the Training for Trainers reimbursed by Wikimedia UK.

7. Wikimedia UK will ensure that their trainers are adequately covered for public liability insurance when training, facilitating or attending meetings on behalf of Wikimedia UK.
Thoughts? I think the underlying idea here is to avoid a situation where people receive free training from WMUK only to then turn around and sell their services as "WMUK-approved trainers" to some company, at £500 a day.

It was originally meant to be a contract, but has now been downgraded to a memorandum of understanding. The relevant diff is here; it also included some other changes.

4. as written implies that you can do that stuff as long as WMUK agrees.

Being a suspicious bastard, why do I feel this is WMUK setting up another revenue stream?

Other than that, its all justifiable really, it costs money to train, or rather it costs money the way WMUK have agreed to the trainer contract. So they need some protection from those seeking a free ride. Did Fae ever get anywhere with his bleating about it btw?

Of course without any binding contract its largely pointless. The only thing that would truely protect them would be a clause that says 'Upon completion of this training, if you use it for personal gain, you must repay the cost of the training'.

Not a bad idea. I might suggest it.
